The Court of Appeal Bar–Bench Committee is a collaborative forum comprising Judges of the Court of Appeal, representatives of the Bar, and Court administration, established to promote constructive engagement, improve the administration of justice, enhance professionalism, and address operational and procedural issues affecting the Court. Proposed changes by the committee are subjected to engagement with stakeholders before final adoption to maintain transparency and accountability.
The members of the committee are;
The Chair of the Committee; Hon Mr Justice Daniel Musinga, JA President Court of Appeal
Judges of the Court of Appeal
Senior Members of the Bar (Senior Counsel and members of the Law Society of Kenya
Members of the Civil Society
Any other member co-opted by the Court
The Secretary to the Committee; Hon Mr Moses Serem, Registrar Court of Appeal
The Mandate of the Committee include among other:
Strengthening cooperation and mutual understanding between the Bench and the Bar
Identifying and resolving challenges in Court processes and practice
Enhancing efficiency in case management and service delivery
Promoting ethical conduct and professional standards
Facilitating continuous dialogue on emerging jurisprudential and procedural issues
Achievements of the Committee among Others
The Committee has had engagement with proposals for amendments to the Court of Appeal Rules 2022, specifically focusing on Rule 5(2)(b) to ensure the “expeditious disposal” of matters.
Backlog Reduction: The committee encourages Alternative Dispute Resolution (ADR), including mediation and arbitration, to ease the existing case backlog.
